Criminal Assault is often a misunderstood crime. While some
states consider criminal assault and criminal battery as the
same crime, the Criminal Statutes of the State of Florida
has distinguished “assault” and “battery” as separate
crimes, with varying degrees as to the level each crime in
order to ensure there are sentencing guidelines appropriate
for the various forms of assault and battery crimes.
Criminal Assault is distinguished as a crime that does not
involve any unwanted and intentional physical contact
between the accused and the alleged victim of assault.
According to Florida Statutes, Criminal Assault is defined
as an intentional, unlawful threat by word or act to do
violence to the person of another, coupled with an apparent
ability to do so, and doing some act which creates a
well-founded fear in such other person that such violence is
imminent.
Commonly called simple assault, if a firearm or deadly
weapon is not used during the alleged assault, the assault
is typically charged as a misdemeanor crime.
If the assault involves a firearm or other deadly weapon the
accused may be charged with aggravated assault which is a
felony crime.
Assault is an inherently objective crime as the “perceived
intent of the accused” by the victim is weighed against the
actual intent of the accused. Another factor that may make
the situation even more objective is if the accused had a
legal carry and conceal permit for a firearm, and at no time
did the accused show – brandish – make mention of – or use
as a threat any reference to the legally carried firearm…
only to have law enforcement find out the accused was
carrying the firearm at the time of the altercation. And
what if the alleged victim uses the knowledge that the
accused is lawfully able to carry a firearm with a lawful
carry and conceal permit, and uses that knowledge out of
spite over a simple argument?
The waters can be a murky with various potential factors of
