batter anyone. A victim does not have to be present during

First Degree Felony Burglary:
Is when an act of burglary occurs and assault, battery, or
carrying a firearm or other deadly weapon is in the
possession of the accused at the time of the alleged
burglary crime. First Degree Felony Burglary may also be
charged if more than $1000.00 in property damage is a direct
