Depending on specific aspects of a Robbery Crime, the charges may be charged as:

Robbery: According to Florida Statute 812.13, Robbery is defined as: “the taking of money or other property which may be the subject of larceny from the person or custody of another, with intent to either permanently or temporarily deprive the person or the owner of the money or other property, when in the course of the taking there is the use of force, violence, assault, or putting in fear”. If in the course of committing the act of robbery the offender carried no firearm, deadly weapon, or other weapon, then the robbery is a felony of the second degree, punishable by a term of imprisonment not exceeding 15 years.

Armed Robbery: If in the course of committing the robbery the offender carried a firearm or other deadly weapon, then the robbery is a felony of the first degree, punishable by imprisonment for a term of years not exceeding life imprisonment.

Strong-Arm Robbery (Robbery by Sudden Snatching): "Robbery by sudden snatching" means the taking of money or other property from the victim's person, with intent to permanently or temporarily deprive the victim or the owner of the money or other property, when, in the course of the taking, the victim was or became aware of the taking. In order to satisfy this definition, it is not necessary to show that:

  • The offender used any amount of force beyond that effort necessary to obtain possession of the money or other property; or

  • There was any resistance offered by the victim to the offender or that there was injury to the victim's person.

Because Robbery is considered a violent crime, if a firearm is used in the commission of the crime, Florida’s 10-20-LIFE Statute may apply, which requires:

  • A 10 year prison sentence for certain felonies when the accused possesses a firearm;

  • 20 years in prison when the gun is fired;

  • 25 years to LIFE sentence if someone is injured or killed;

  • A 3 year prison sentence for Possession of a Firearm by a Convicted Felon;

  • The prison sentence must be served consecutively (after) any other prison sentence.

In recent years this Florida’s 10-20-LIFE law has come under great scrutiny because this law unfairly empowers prosecutors but handcuffs judges, juries, defense attorneys, and therefore is designed to provide an unfair advantage to the State obtain longer periods of incarceration based on each individual case, as well as allowing prosecutors being able to force a defendant to take a plea deal with the threat of the mandatory minimums associated with the 10-20-LIFE law. Because of this it may be extremely important to seek the legal advice and representation who will aggressively fight to protect your legal rights and freedoms.
